應屆生的(de)人生第一份勞動合同(tong),容易踩(cai)的(de) 5 個坑如下:

一、離職不會有(you)違約金(jin)。不管(guan)是(shi)試(shi)用期還(huan)是(shi)轉正后,只要想離職,都可(ke)放心大膽地(di)提,即便(bian)合同上寫了(le)相(xiang)關條款,也屬違法,不會生效(xiao)。

四、合同(tong)一(yi)式兩(liang)份(fen),自己那份(fen)要保管好:若有爭議,這是(shi)重要證據之一(yi)。

五、關于試(shi)用(yong)期(qi)(qi)(qi)(qi)。試(shi)用(yong)期(qi)(qi)(qi)(qi)薪資可打折,但(dan)不(bu)(bu)能低于轉正(zheng)后的百分(fen)之(zhi)八十。試(shi)用(yong)期(qi)(qi)(qi)(qi)時長有規定,勞(lao)動合同(tong)期(qi)(qi)(qi)(qi)限(xian)在三個(ge)月以(yi)上(shang)不(bu)(bu)滿一年(nian)的,試(shi)用(yong)期(qi)(qi)(qi)(qi)不(bu)(bu)得(de)超過(guo)(guo)一個(ge)月;一年(nian)以(yi)上(shang)不(bu)(bu)滿三年(nian)的,試(shi)用(yong)期(qi)(qi)(qi)(qi)不(bu)(bu)得(de)超過(guo)(guo)二個(ge)月;三年(nian)以(yi)上(shang)固定期(qi)(qi)(qi)(qi)限(xian)和無(wu)固定期(qi)(qi)(qi)(qi)限(xian)的勞(lao)動合同(tong),試(shi)用(yong)期(qi)(qi)(qi)(qi)不(bu)(bu)得(de)超過(guo)(guo)六(liu)個(ge)月。

具體畢業生簽訂勞動合同時需要(yao)注意以下方面:

一(yi)、必備條(tiao)(tiao)款(kuan)。根(gen)據《勞(lao)動(dong)合(he)同(tong)法》第十七(qi)條(tiao)(tiao)規定(ding),勞(lao)動(dong)合(he)同(tong)應(ying)當(dang)具備用(yong)(yong)人(ren)(ren)單(dan)位(wei)的(de)名(ming)稱、住所和(he)(he)法定(ding)代表人(ren)(ren)或者(zhe)(zhe)(zhe)主要負責人(ren)(ren);勞(lao)動(dong)者(zhe)(zhe)(zhe)的(de)姓名(ming)、住址(zhi)和(he)(he)居民(min)身份證(zheng)或者(zhe)(zhe)(zhe)其他(ta)有效身份證(zheng)件(jian)(jian)號(hao)碼(ma);勞(lao)動(dong)合(he)同(tong)期限;工(gong)(gong)(gong)作內容(rong)和(he)(he)工(gong)(gong)(gong)作地點;工(gong)(gong)(gong)作時(shi)間(jian)和(he)(he)休(xiu)息休(xiu)假(jia);勞(lao)動(dong)報酬(chou);社會保(bao)險;勞(lao)動(dong)保(bao)護、勞(lao)動(dong)條(tiao)(tiao)件(jian)(jian)和(he)(he)職(zhi)業(ye)危害防(fang)護;法律、法規規定(ding)應(ying)當(dang)納入勞(lao)動(dong)合(he)同(tong)的(de)其他(ta)事項(xiang)。除前(qian)款(kuan)規定(ding)的(de)必備條(tiao)(tiao)款(kuan)外,用(yong)(yong)人(ren)(ren)單(dan)位(wei)與(yu)勞(lao)動(dong)者(zhe)(zhe)(zhe)可以約(yue)定(ding)試用(yong)(yong)期、培訓(xun)、保(bao)守秘密(mi)、補充保(bao)險和(he)(he)福利待遇(yu)等其他(ta)事項(xiang)。

二、簽訂(ding)時間。建立(li)(li)(li)勞(lao)(lao)(lao)(lao)動關系(xi),應當(dang)訂(ding)立(li)(li)(li)書面(mian)(mian)勞(lao)(lao)(lao)(lao)動合(he)同(tong)(tong)(tong),已建立(li)(li)(li)勞(lao)(lao)(lao)(lao)動關系(xi),未同(tong)(tong)(tong)時訂(ding)立(li)(li)(li)書面(mian)(mian)勞(lao)(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)的,應當(dang)自(zi)用(yong)工(gong)之(zhi)日起(qi)一個月(yue)內訂(ding)立(li)(li)(li)書面(mian)(mian)勞(lao)(lao)(lao)(lao)動合(he)同(tong)(tong)(tong),用(yong)人單位與勞(lao)(lao)(lao)(lao)動者(zhe)(zhe)在用(yong)工(gong)前訂(ding)立(li)(li)(li)勞(lao)(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)的,勞(lao)(lao)(lao)(lao)動關系(xi)自(zi)用(yong)工(gong)之(zhi)日起(qi)建立(li)(li)(li)。用(yong)人單位自(zi)用(yong)工(gong)之(zhi)日起(qi)超過 1 個月(yue)不(bu)滿(man) 1 年未與勞(lao)(lao)(lao)(lao)動者(zhe)(zhe)訂(ding)立(li)(li)(li)書面(mian)(mian)勞(lao)(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)的,應當(dang)向勞(lao)(lao)(lao)(lao)動者(zhe)(zhe)每月(yue)支付二倍的工(gong)資(zi)。

三、合同(tong)類型。勞(lao)動合同(tong)分為固(gu)定期(qi)限、無固(gu)定期(qi)限和(he)以完成一(yi)定工作(zuo)任務為期(qi)限三類。

四、試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)規定(ding)。勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)限(xian)三(san)個月(yue)(yue)以上不(bu)滿一年(nian)的,試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)不(bu)得(de)(de)超過(guo)(guo) 1 個月(yue)(yue);勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)限(xian)一年(nian)以上不(bu)滿三(san)年(nian)的,試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)不(bu)得(de)(de)超過(guo)(guo) 2 個月(yue)(yue);三(san)年(nian)以上固定(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)和無固定(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)的勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong),試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)不(bu)得(de)(de)超過(guo)(guo) 6 個月(yue)(yue)。同(tong)(tong)一用(yong)(yong)(yong)人(ren)單位(wei)與(yu)同(tong)(tong)一勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)只(zhi)能約(yue)定(ding)一次試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)。試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)的工(gong)資(zi)不(bu)得(de)(de)低(di)于本單位(wei)相同(tong)(tong)崗位(wei)*檔工(gong)資(zi)或者(zhe)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)約(yue)定(ding)工(gong)資(zi)的 80%,并不(bu)得(de)(de)低(di)于用(yong)(yong)(yong)人(ren)單位(wei)所在地的*工(gong)資(zi)標(biao)準。試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)包(bao)含在勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)限(xian)內(nei)(nei)(nei),用(yong)(yong)(yong)人(ren)單位(wei)應當自用(yong)(yong)(yong)工(gong)之(zhi)日起 30 日內(nei)(nei)(nei)為職工(gong)向社會保險經(jing)辦機(ji)構申請辦理(li)社會保險登記(ji)。用(yong)(yong)(yong)人(ren)單位(wei)不(bu)得(de)(de)無理(li)由隨意解除與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)在試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)內(nei)(nei)(nei)的勞(lao)(lao)(lao)(lao)動(dong)(dong)關(guan)系,勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)在試用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)(qi)間被證明不(bu)符合(he)(he)錄用(yong)(yong)(yong)條件的,用(yong)(yong)(yong)人(ren)單位(wei)可(ke)以解除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。

五、其他(ta)注(zhu)意(yi)(yi)事項。避免簽訂 “自(zi)愿(yuan)放棄繳納社會(hui)保(bao)(bao)險(xian)費” 的(de)(de)(de)協議,社會(hui)保(bao)(bao)險(xian)屬于(yu)(yu)國(guo)(guo)家強制(zhi)性保(bao)(bao)險(xian),用人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)和(he)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)必(bi)須依法(fa)參加社會(hui)保(bao)(bao)險(xian),繳納社會(hui)保(bao)(bao)險(xian)費;注(zhu)意(yi)(yi)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)是(shi)(shi)否(fou)(fou)(fou)具備《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)法(fa)》規(gui)定(ding)(ding)的(de)(de)(de)必(bi)備條款,以及有關(guan)用人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)義務和(he)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)權利的(de)(de)(de)條款是(shi)(shi)否(fou)(fou)(fou)缺失;意(yi)(yi)向(xiang)書不(bu)能(neng)代替勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)一般產生于(yu)(yu)意(yi)(yi)向(xiang)書之后,如(ru)果勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)約定(ding)(ding)的(de)(de)(de)內容(rong)與(yu)意(yi)(yi)向(xiang)書不(bu)一致,那么視(shi)為用人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)就同(tong)(tong)(tong)一問(wen)題作了(le)新(xin)的(de)(de)(de)約定(ding)(ding),應以勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)為準(zhun);對于(yu)(yu)一些(xie)單(dan)(dan)位(wei)(wei)(wei)(wei)為員工(gong)(gong)(gong)(gong)提供的(de)(de)(de)如(ru)出(chu)國(guo)(guo)進修等(deng)(deng)特殊培(pei)訓,需(xu)注(zhu)意(yi)(yi)服務期限的(de)(de)(de)約定(ding)(ding);用人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)通常會(hui)將《員工(gong)(gong)(gong)(gong)手冊》、相關(guan)規(gui)章(zhang)制(zhi)度等(deng)(deng)附在(zai)(zai)(zai)(zai)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)后面,或在(zai)(zai)(zai)(zai)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)中(zhong)約定(ding)(ding)上述(shu)文(wen)件(jian)為附件(jian),經過確(que)認告(gao)知的(de)(de)(de)附件(jian)對雙(shuang)(shuang)方(fang)均(jun)有效,雙(shuang)(shuang)方(fang)均(jun)應遵守;勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)應要求與(yu)用人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)訂立(li)書面合(he)(he)(he)同(tong)(tong)(tong),并保(bao)(bao)留一份合(he)(he)(he)同(tong)(tong)(tong),合(he)(he)(he)同(tong)(tong)(tong)文(wen)本應由(you)用人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)和(he)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)各執一份;如(ru)果合(he)(he)(he)同(tong)(tong)(tong)上的(de)(de)(de)單(dan)(dan)位(wei)(wei)(wei)(wei)與(yu)入職企業不(bu)一致,需(xu)特別注(zhu)意(yi)(yi)審查中(zhong)間(jian)(jian)是(shi)(shi)否(fou)(fou)(fou)存(cun)在(zai)(zai)(zai)(zai)第三方(fang)單(dan)(dan)位(wei)(wei)(wei)(wei),以及承(cheng)包方(fang)有無履行(xing)合(he)(he)(he)同(tong)(tong)(tong)的(de)(de)(de)資質和(he)能(neng)力等(deng)(deng);仔細閱讀合(he)(he)(he)同(tong)(tong)(tong)約定(ding)(ding),拒絕簽訂女職工(gong)(gong)(gong)(gong)不(bu)得結婚生育、因工(gong)(gong)(gong)(gong)負(fu)傷的(de)(de)(de) “工(gong)(gong)(gong)(gong)傷自(zi)理”、要求勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)簽訂生死(si)契約等(deng)(deng)不(bu)合(he)(he)(he)法(fa)的(de)(de)(de)內容(rong);注(zhu)意(yi)(yi)合(he)(he)(he)同(tong)(tong)(tong)中(zhong)關(guan)于(yu)(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)報酬的(de)(de)(de)構成、工(gong)(gong)(gong)(gong)作崗位(wei)(wei)(wei)(wei)、工(gong)(gong)(gong)(gong)作地點、支付(fu)(fu)方(fang)式(shi)與(yu)支付(fu)(fu)時間(jian)(jian)等(deng)(deng)信息是(shi)(shi)否(fou)(fou)(fou)明(ming)確(que)具體(ti);在(zai)(zai)(zai)(zai)簽訂勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)時,要了(le)解清楚單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)基(ji)本情況,判斷其是(shi)(shi)否(fou)(fou)(fou)為合(he)(he)(he)法(fa)企業,并將相關(guan)信息明(ming)確(que)寫(xie)在(zai)(zai)(zai)(zai)合(he)(he)(he)同(tong)(tong)(tong)中(zhong)。
