但是(shi)(shi)用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)基于(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)法(fa)的(de)(de)(de)規定(ding)在勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)中對(dui)法(fa)定(ding)解(jie)除條件(jian)可(ke)以(yi)進(jin)行具體的(de)(de)(de)量化,這是(shi)(shi)可(ke)以(yi)的(de)(de)(de)。比如說(shuo)在勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)中明確(que)約定(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)嚴重違反用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)規章制度(du)的(de)(de)(de)具體的(de)(de)(de)情形是(shi)(shi)哪(na)些,并據(ju)此(ci)(ci)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)是(shi)(shi)可(ke)以(yi)的(de)(de)(de)。用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)還可(ke)以(yi)制定(ding)管理(li)(li)制度(du)、考核制度(du)對(dui)員(yuan)(yuan)(yuan)工的(de)(de)(de)工作進(jin)行考核管理(li)(li),比如對(dui)銷(xiao)售人(ren)(ren)(ren)員(yuan)(yuan)(yuan)設定(ding)符(fu)合(he)(he)(he)(he)實際的(de)(de)(de)銷(xiao)售指(zhi)標,如果銷(xiao)售人(ren)(ren)(ren)員(yuan)(yuan)(yuan)業績不(bu)達(da)(da)標是(shi)(shi)員(yuan)(yuan)(yuan)工的(de)(de)(de)工作能(neng)力達(da)(da)不(bu)到(dao)崗位(wei)(wei)需(xu)求的(de)(de)(de)表現(xian),也是(shi)(shi)不(bu)勝(sheng)任工作的(de)(de)(de)表現(xian)。根據(ju)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)法(fa)第四十(shi)條的(de)(de)(de)規定(ding),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)不(bu)勝(sheng)任工作的(de)(de)(de),用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)應先進(jin)行培訓(xun)或調崗處(chu)理(li)(li),如果培訓(xun)或調崗處(chu)理(li)(li)后仍不(bu)能(neng)勝(sheng)任的(de)(de)(de),用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)才(cai)有(you)權解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong),而且此(ci)(ci)種情況下用(yong)人(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)仍是(shi)(shi)需(xu)要(yao)支付勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)經濟補償的(de)(de)(de)。因此(ci)(ci)銷(xiao)售員(yuan)(yuan)(yuan)業績不(bu)達(da)(da)標并不(bu)能(neng)直接解(jie)除他的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)。
