我們身邊有很多人(ren)(ren)喜歡共享用(yong)(yong)(yong)工(gong)的(de)(de)(de)(de)(de)模式,但是(shi)如果員(yuan)工(gong)和(he)一(yi)(yi)(yi)個(ge)(ge)(ge)企(qi)業(ye)沒有長期穩(wen)定(ding)和(he)固定(ding)的(de)(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)的(de)(de)(de)(de)(de)話,就會(hui)產生另外一(yi)(yi)(yi)個(ge)(ge)(ge)問(wen)題,就是(shi)員(yuan)工(gong)穩(wen)定(ding)性就沒有那么好(hao)。那么共享用(yong)(yong)(yong)工(gong)、兼職用(yong)(yong)(yong)工(gong)、靈(ling)活(huo)用(yong)(yong)(yong)工(gong)的(de)(de)(de)(de)(de)方式,企(qi)業(ye)擔(dan)心(xin)的(de)(de)(de)(de)(de)部(bu)分也就是(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)在待崗期間會(hui)去尋(xun)求其(qi)他(ta)(ta)的(de)(de)(de)(de)(de)工(gong)作機(ji)會(hui),這樣的(de)(de)(de)(de)(de)話一(yi)(yi)(yi)個(ge)(ge)(ge)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)在同(tong)(tong)(tong)一(yi)(yi)(yi)時期內(nei)就會(hui)和(he)兩(liang)個(ge)(ge)(ge)或(huo)兩(liang)個(ge)(ge)(ge)以(yi)上的(de)(de)(de)(de)(de)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)存在勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)。而勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)法(fa)(fa)規定(ding)說(shuo)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)一(yi)(yi)(yi)般只能(neng)和(he)一(yi)(yi)(yi)個(ge)(ge)(ge)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)建(jian)立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi),隸屬存在勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)的(de)(de)(de)(de)(de)這個(ge)(ge)(ge)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)為他(ta)(ta)繳納社(she)會(hui)保(bao)險,建(jian)立人(ren)(ren)事檔案。那么其(qi)他(ta)(ta)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)不(bu)可(ke)能(neng)重復地(di)為他(ta)(ta)建(jian)立人(ren)(ren)事檔案繳納社(she)保(bao),那么勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)(fa)一(yi)(yi)(yi)直是(shi)沿用(yong)(yong)(yong)這個(ge)(ge)(ge)法(fa)(fa)條和(he)規則的(de)(de)(de)(de)(de)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)(fa)第(di)(di)三十八條第(di)(di)四款有這樣的(de)(de)(de)(de)(de)規定(ding),說(shuo)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)同(tong)(tong)(tong)時和(he)其(qi)他(ta)(ta)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)建(jian)立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi),對完成(cheng)本單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)的(de)(de)(de)(de)(de)工(gong)作任務造(zao)成(cheng)嚴重影(ying)響(xiang)或(huo)者(zhe)(zhe)經用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)提出拒(ju)不(bu)改正的(de)(de)(de)(de)(de),用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)可(ke)單(dan)(dan)(dan)(dan)(dan)方解除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)。那么第(di)(di)九十一(yi)(yi)(yi)條規定(ding)說(shuo)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)招用(yong)(yong)(yong)和(he)其(qi)他(ta)(ta)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)尚(shang)未解除或(huo)者(zhe)(zhe)終止勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)的(de)(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe),給其(qi)他(ta)(ta)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)造(zao)成(cheng)損失的(de)(de)(de)(de)(de)應當承(cheng)擔(dan)連帶(dai)的(de)(de)(de)(de)(de)賠償責任。根據上述的(de)(de)(de)(de)(de)規定(ding),在雙(shuang)重或(huo)者(zhe)(zhe)多重勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)中,只要(yao)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)沒有給原單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)造(zao)成(cheng)損失,那和(he)其(qi)他(ta)(ta)單(dan)(dan)(dan)(dan)(dan)位(wei)(wei)建(jian)立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)(tong)關系(xi)的(de)(de)(de)(de)(de)行為并不(bu)違法(fa)(fa)。而在現實的(de)(de)(de)(de)(de)用(yong)(yong)(yong)工(gong)關系(xi)中,一(yi)(yi)(yi)般雙(shuang)重勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)的(de)(de)(de)(de)(de)情況主要(yao)包(bao)括。
一(yi)(yi)、就是勞(lao)(lao)動者(zhe)在(zai)一(yi)(yi)個企業(ye)內(nei)部停(ting)(ting)薪(xin)留職、未(wei)達(da)到(dao)法(fa)定(ding)(ding)退休年(nian)齡內(nei)退了(le)或者(zhe)是下崗(gang)(gang)待(dai)崗(gang)(gang)人(ren)員(yuan)(yuan)(yuan)以及企業(ye)經營(ying)性(xing)停(ting)(ting)產放長假的(de)人(ren)員(yuan)(yuan)(yuan)。那(nei)么最(zui)高人(ren)民(min)法(fa)院關(guan)于審理勞(lao)(lao)動爭議(yi)(yi)案(an)件適用法(fa)律若干(gan)規定(ding)(ding)的(de)解(jie)釋(shi)三也(ye)有規定(ding)(ding)說,且(qie)停(ting)(ting)薪(xin)留職、未(wei)達(da)到(dao)法(fa)定(ding)(ding)退休年(nian)齡的(de)內(nei)退人(ren)員(yuan)(yuan)(yuan)、下崗(gang)(gang)待(dai)崗(gang)(gang)人(ren)員(yuan)(yuan)(yuan)以及企業(ye)經營(ying)性(xing)停(ting)(ting)產放長假人(ren)員(yuan)(yuan)(yuan)因與新(xin)的(de)用人(ren)單位發生爭議(yi)(yi),提起訴(su)訟的(de),那(nei)么法(fa)院應當按(an)照勞(lao)(lao)動關(guan)系來處理。
二(er)、就是(shi)非全(quan)(quan)日(ri)制用工(gong)。包(bao)括每天工(gong)作不超過四個(ge)小時或(huo)者是(shi)小時工(gong)這(zhe)種用工(gong)形式。從事非全(quan)(quan)日(ri)制用工(gong)的(de)勞動(dong)(dong)者可以(yi)與一個(ge)或(huo)一個(ge)以(yi)上用工(gong)單位訂(ding)(ding)立勞動(dong)(dong)合(he)同,但是(shi)后(hou)訂(ding)(ding)立的(de)勞動(dong)(dong)合(he)同不得影響(xiang)先(xian)訂(ding)(ding)立的(de)勞動(dong)(dong)合(he)同的(de)履行。
三、就(jiu)是兼(jian)(jian)(jian)職。那么兼(jian)(jian)(jian)職有三種情形(xing),一(yi)類(lei)是勞(lao)動者(zhe)向用(yong)人單(dan)位(wei)提(ti)供不(bu)定(ding)時的(de)技術或者(zhe)信息咨詢服務,我們一(yi)般(ban)叫他為顧(gu)問(wen)式服務。第二類(lei)呢就(jiu)是勞(lao)動者(zhe)提(ti)供勞(lao)務服務的(de)臨(lin)時性用(yong)工(gong)比(bi)較多。第三類(lei)呢就(jiu)是勞(lao)動者(zhe)定(ding)時向用(yong)人單(dan)位(wei)提(ti)供非全日制(zhi)勞(lao)動,兼(jian)(jian)(jian)職服務以一(yi)家(jia)以上的(de)企業也很正常,一(yi)般(ban)不(bu)會產生爭議。
四(si)、就(jiu)是(shi)共(gong)(gong)享用(yong)(yong)工(gong)(gong)。一般像勞(lao)務派遣公司、缺(que)工(gong)(gong)企業和(he)(he)勞(lao)動(dong)(dong)力營與(yu)企業之間(jian)實行(xing)的這種共(gong)(gong)享用(yong)(yong)工(gong)(gong)進行(xing)用(yong)(yong)工(gong)(gong)逾(yu)缺(que)的司發調劑(ji),屬于勞(lao)動(dong)(dong)力戒掉行(xing)為(wei)。在(zai)一定程度上提(ti)高了人力資源的配置(zhi)效(xiao)率(lv),但(dan)共(gong)(gong)享員(yuan)工(gong)(gong)并未改變原用(yong)(yong)人單(dan)位和(he)(he)勞(lao)動(dong)(dong)者(zhe)之間(jian)的勞(lao)動(dong)(dong)關(guan)系。可(ke)以安排被戒掉員(yuan)工(gong)(gong)和(he)(he)原用(yong)(yong)人單(dan)位簽訂(ding)書面的變更勞(lao)動(dong)(dong)合同協議(yi),只要不做違(wei)法派遣,那么(me)做好員(yuan)工(gong)(gong)的勞(lao)動(dong)(dong)保護權(quan)益的保護,基本(ben)也(ye)不會(hui)有爭議(yi)和(he)(he)問(wen)題出現(xian)。
