一、加(jia)班(ban)工(gong)(gong)資(zi)的(de)計算(suan)(suan)基(ji)(ji)數(shu),可以按(an)(an)勞(lao)動(dong)合(he)同(tong)當中約(yue)定(ding)的(de)基(ji)(ji)數(shu)為準,而不(bu)(bu)是一定(ding)要與員工(gong)(gong)實際全額工(gong)(gong)資(zi)進(jin)(jin)行核(he)算(suan)(suan),但約(yue)定(ding)的(de)這(zhe)個(ge)基(ji)(ji)數(shu),不(bu)(bu)得低于(yu)當地月*工(gong)(gong)資(zi)標(biao)準。比如(ru)小(xiao)王(wang)每個(ge)月的(de)實際工(gong)(gong)資(zi)是五(wu)千(qian),但勞(lao)動(dong)合(he)同(tong)當中注(zhu)明了(le)其加(jia)班(ban)工(gong)(gong)資(zi)的(de)計算(suan)(suan)基(ji)(ji)數(shu)為二千(qian)五(wu),且二千(qian)五(wu)已經高于(yu)了(le)當地的(de)月*工(gong)(gong)資(zi)標(biao)準,那么在核(he)算(suan)(suan)加(jia)班(ban)工(gong)(gong)資(zi)時(shi),可以按(an)(an)照兩千(qian)五(wu)進(jin)(jin)行核(he)算(suan)(suan)。

二、如(ru)果公司與員工(gong)(gong)(gong),沒有(you)在(zai)勞動(dong)合(he)同中明確約(yue)定加(jia)班工(gong)(gong)(gong)資(zi)的核算基(ji)數(shu),但約(yue)定了(le)各(ge)類獎(jiang)金、津貼(tie)、補貼(tie)等項目(mu),不屬(shu)于正常工(gong)(gong)(gong)作時間(jian)工(gong)(gong)(gong)資(zi)的,則在(zai)計(ji)(ji)算加(jia)班工(gong)(gong)(gong)資(zi)時,核算基(ji)數(shu)為全(quan)額(e)工(gong)(gong)(gong)資(zi)減去以上這(zhe)些項目(mu)之后的余(yu)額(e)。如(ru)小王(wang)每個月(yue)的實(shi)際工(gong)(gong)(gong)資(zi)是五(wu)(wu)千(qian),但其(qi)中有(you)兩千(qian)元是獎(jiang)金和津貼(tie),那么(me)他加(jia)班工(gong)(gong)(gong)資(zi)的核算基(ji)數(shu)就是五(wu)(wu)千(qian)減去兩千(qian)等于三千(qian)塊。但這(zhe)樣計(ji)(ji)算的前提是雙方在(zai)勞動(dong)合(he)同當中注明了(le)獎(jiang)金津貼(tie)這(zhe)些項目(mu),不屬(shu)于正常工(gong)(gong)(gong)作時間(jian)的工(gong)(gong)(gong)資(zi)。
